HC issues notice in PIL on tainted blood transfusion

The Gujarat High Court on Thursday issued notice to the additional secretary  in charge of National Aids Control Organisation, drug controller of India, ministry of health and family welfare, Gujarat state council for blood transfusion, health department of Gujarat and police inspector, ‘B’ division police station, Junagadh in a matter involving HIV infected blood transfusion to 23 Thalassemic children in Junagadh civil hospital. A division bench comprising Acting Chief Justice Bhaskar Bhattacharya and Justice AL Dave issued the notice based on the public interest litigation (PIL) filed by a Gujarat HC lawyer Girish Das. The court has given frespondents four weeks to file a reply. Next hearing will be held on December 8. Das had filed the PIL on the basis of complaint made by a victim’s father.
The petitioner, in the PIL, has requested that an investigation should be initiated against doctors, authorities, blood suppliers, donors and others who were involved in this kind of activity. The petition also mentioned that state government should ensure that the hospital transfusion committees are established in all hospitals to guide, monitor and audit clinical use of blood. Further the petitioner also prayed for compensation for loss of the victims’ fundamental rights.
