Allahabad High Court suspends Judge OP Mishra for granting bail to former UP Minister Gayatri Prajapati

 The Allahabad High Court on Friday suspended OP Mishra, the POCSO court special judge for granting bail to the rape-accused Samajwadi Party leader Gayatri Prajapati. Suspending Mishra, the Court has also ordered a departmental inquiry on the same. Opposing the bail granted by the special court, the Yogi-Adityanath-led state government has challenged the bail in the High Court.

Stating that the circumstances under which the bail has been granted as highly objectionable, it is been reported that the High Court has asked Justice Sudhir Agrawal to investigate the matter against OP Mishra. OP Mishra is due to retire on April 30.

Granting bail to Gayatri Prajapati and his two accomplices, OP Mishra said that it was consensual sex and questioned why did the convict not protest in the past three years. Gayatri Prajapati was granted bail on a personal bond of Rs 1 lakh.

However, the bail was later put on hold “until further orders” by Chief Justice Dilip Bhosle. Questioning the basis of granting bail, Justice Dilip Bhosale said, “I may, however, observe that the manner in which the learned judge has shown the haste in releasing the accused on bail ignoring the nature of offence allegedly committed by the respondent accused and the fact that the crime came to be registered against these accused by virtue of the order of the Supreme Court dated 17/2/2017.I have my reservations about the bonafides/intention of the learned judge who is about to retire on 30/4/2017.”

After absconding for over two weeks in the middle of the campaigning for the Uttar Pradesh Assembly elections, former state minister Gayatri Prajapati was arrested in Lucknow last month. On the allegation of a woman that had claimed the minister along with six others to gang rape her and attempt to rape her 16year-old daughter, the Supreme Court had ordered the state police to file a case against the then state minister.
