Lodge case against Rais Khan - Special SIT court

Ahmedabad: Rais Khan’s move against his former employer and activist Teesta Setalvad seems to have boomeranged. A special court hearing the 2002 Naroda Gam case on Friday directed the registrar of the city sessions court to lodge a complaint against Khan and his associates for furnishing false evidence.

While dismissing Khan’s plea to treat him as a witness so that he could testify against Setalvad, designated judge SH Vora also asked the registrar to register an offence against Khan and others for giving false evidence in the Naroda Gam case despite knowing that it was fabricated.
In his application, Khan narrated how Setalvad had tutored witnesses and false affidavits were filed before the Supreme Court.
“Instead of respecting the judicial process, the applicant (Khan) and others have made an attempt to take advantage of situation by pursuing the victims/witnesses to sign such affidavits,” the court observed. “This is nothing, but there was an attempt on the part of the applicant and others to undermine the judicial process and it amounts to interference in the administration of public justice. It undermines the free flow of unspoiled stream of justice and aims at striking a blow at the rule of law.”
SIT’s special prosecutor Ajay Choksy had submitted Khan should be made an accused instead of a witness. He had contended the apex court set up the SIT in April 2008, but Khan did not tell investigators about the facts and approached the court with the intention of damaging the prosecution case. The charges to be leveled against Khan and others are punishable with up to life imprisonment.
