SC clears way to raze Navi Mumbai temple

The Supreme Court on Monday dismissed the special leave petition (SLP) filed by the Bavkhaleshwar Temple Trust challenging a Bombay HC demolition order for encroachments on MIDC (Maharashtra Industrial Development Corporation) land at Pawane here.
“A two-judge SC bench of Justices Madan Lokur and Deepak Gupta dismissed the temple trust’s SLP, upholding the 2013 Bombay high court order on this issue. This essentially means that MIDC is now free to start clearing all encroachments from its property in Navi Mumbai,” said Aniruddha Joshi, lawyer of RTI activist Sandeep Thakur who had moved the high court against encroachments on MIDC and Cidco land.
“I welcome the Supreme Court order. In the past too, the temple trust had filed a couple of SLPs such as maintaining status quo of the structures on MIDC property, and that the agency (MIDC) is formulating a special temple policy. However, the apex court has dismissed their SLP. The temple structure, along with a private office complex and an artificial pond, comprises an encroachment of around 10,000 sq m on the 1.4 lakh sq m MIDC land at Pawane.
