HC orders inquiry against cop for framing lawyer

Ahmedabad: The Gujarat high court has directed the Banaskantha superintendent of police to conduct an inquiry against a police sub-inspector of Vav, J R Patel, and submit the report to DGP for further action. Justice S R Brahmbhatt passed the order after an advocate, Idris Pathan, approached HC to get an FIR against him quashed. This complaint was filed by PSI Patel based on the statement of an accused. But the accused turned up before the judge to reveal that he had made the statement against Patel under duress.
Advocate Pathan had appeared for a dalit person arrested in connection with an offence, who complained against PSI Patel of torturing him in custody. The cop was rebuked by the court in this case. Pathan has alleged that, acting in vengeance, Patel framed him in a fake complaint filed by a person arrested in the same offence concerning the dalit person. Pathan was accused of not filing an application even after accepting fees from the complainant. The PSI lodged the FIR at Vav police station and transferred it to Palanpur.
Justice Brahmbhatt quashed the FIR and directed Banaskantha SP to inquire into the incident and report to DGP.
